This vacant land of 27.32 hectares lies directly against the existing urban edge of Uilkraalsmond and Franskraal in the Overstrand, close to the lagoon at Uilkraalsmond and the coast. It is reached straight off the divisional road that serves the smallholdings around it.

The land is natural fynbos, with invasive alien plants to be cleared. Nothing is built on it.

Zoning and Environment

The land is zoned Agriculture Zone I. The seller states that no restrictive title conditions limit development. An environmental Record of Decision has been issued confirming that the proposed development is not a listed activity under the Environment Conservation Act, and specialist studies are available.

The Development Concept

A planning and environmental background document was prepared earlier for the wider area. It sets out a low-density residential and environmental estate: residential erven with most of the land kept as private open space, informal private roads, vernacular building guidelines, indigenous landscaping and a home owners'' association, balancing homes with the care of the fynbos, ecological corridors and buffers along the lagoon. Residential Zone I and Open Space Zone II were the zonings considered.

No development rights have been obtained. Rezoning, subdivision and the related approvals still have to be applied for, and the decision rests with the Overstrand Municipality and the other authorities. How many homes, if any, may be built depends on the approved layout, the environmental conditions, municipal policy and the formal application. Price and Terms

The asking price is R3 745 000. The land is held in a close corporation, so the sale may be made as a transfer of the members'' interest. Whether transfer duty or VAT then applies depends on how the sale is structured and is for the conveyancer and a tax adviser to confirm. All other costs are for the buyer.
